1. Introduction

Rock'n Rideshare ("Company," "we," "us," or "our") is a Transportation Network Company (TNC) operating in the State of Florida pursuant to Florida Statute § 627.748. We operate the Rock'n Rideshare mobile application and website (collectively, the "Platform") to connect independent contractor drivers with riders seeking prearranged transportation services.

This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our Platform. By accessing or using Rock'n Rideshare, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree, please do not use our Platform.

This Policy applies to all users of the Platform, including riders, drivers, and visitors to our website. It is designed to comply with applicable privacy laws including the Florida Digital Bill of Rights (FDBR, effective July 1, 2024), the California Consumer Privacy Act (CCPA), the Children's Online Privacy Protection Act (COPPA), and applicable provisions of the EU General Data Protection Regulation (GDPR) where applicable.

2. Information We Collect

2.1 Information You Provide Directly

When you register for or use our Platform, we collect information you voluntarily provide, including your full name, email address, date of birth (for age verification), profile photograph, and payment card information. Drivers additionally provide their driver's license number and photograph, vehicle registration, vehicle insurance policy details, Social Security Number (for background check processing), vehicle make, model, year, color, and license plate number, as well as a mailing address for the driver identification sticker program.

2.2 Information Collected Automatically

When you use our Platform, we automatically collect precise GPS location data (latitude and longitude) from your device during active ride sessions and, for drivers, while logged into the driver application. We also collect device identifiers, operating system version, app version, IP address, browser type, and usage data including ride history, search queries, and in-app interactions. This data is necessary to provide core Platform functionality.

2.3 Audio and Video Recording

Rock'n Rideshare requires all drivers to operate dashcam equipment that records both the front exterior and the interior passenger cabin of the vehicle during active rides. All riders and drivers are required to provide explicit consent to audio and video recording before a ride begins. This recording is conducted for safety purposes, insurance compliance, and dispute resolution, consistent with Florida Statute § 934.03 (Florida Security of Communications Act), which requires all-party consent for recording oral communications. Recordings are stored securely and accessed only in connection with safety investigations, insurance claims, or legal proceedings.

2.4 Uploaded Documents

Drivers are required to upload copies of their driver's license, vehicle insurance policy, vehicle registration, and motor vehicle record (MVR). These documents are stored securely using encrypted cloud storage and are accessed only by authorized Rock'n Rideshare personnel for driver verification purposes.

2.5 Payment Information

Payment card information is collected and processed through our payment processor. We store only the card brand, last four digits, and expiration date for display purposes. Full card numbers are never stored on our servers. All payment transactions are encrypted using industry-standard TLS/SSL protocols.

Our web Platform uses cookies and similar tracking technologies. Please see our separate for full details. You may manage your cookie preferences at any time through our cookie consent banner or your browser settings.

3. How We Use Your Information

We use the personal information we collect for the following purposes:

  • Providing the Service: Matching riders with available drivers, processing ride requests, calculating and collecting fares, and facilitating communication between riders and drivers.
  • Safety and Security: Conducting driver background checks, verifying driver credentials, monitoring ride safety, storing dashcam recordings for safety investigations, and enforcing our community standards.
  • Identity and Age Verification: Verifying that riders are at least 13 years of age and that drivers meet all applicable licensing and insurance requirements under Florida law.
  • Payment Processing: Charging riders for completed rides, processing cancellation fees, cleanup fees, and other applicable charges.
  • Legal Compliance: Complying with Florida Statute § 627.748 (Transportation Network Companies), applicable insurance regulations, and responding to lawful requests from law enforcement or regulatory authorities.
  • Customer Support: Responding to inquiries, resolving disputes, and addressing complaints.
  • Platform Improvement: Analyzing usage patterns to improve the Platform's features, reliability, and user experience.
  • Communications: Sending ride confirmations, receipts, safety alerts, and service updates. We do not send marketing communications without your explicit consent.

4. How We Share Your Information

We do not sell your personal information to third parties. We share your information only in the following circumstances:

  • Between Riders and Drivers: When a ride is matched, the rider's first name and pickup location are shared with the driver. The driver's name, photograph, vehicle information, and license plate number are shared with the rider, as required by Florida Statute § 627.748(5).
  • Service Providers: We share data with third-party service providers who assist us in operating the Platform, including payment processors, cloud storage providers, background check services, and mapping services. These providers are contractually bound to use your data only as directed by us.
  • Insurance and Legal Purposes: In the event of an accident or insurance claim, we may share relevant ride data, driver information, and dashcam recordings with insurance companies and legal representatives as required by Florida Statute § 627.748(7)(h).
  • Law Enforcement: We may disclose your information in response to a valid court order, subpoena, or lawful request from law enforcement authorities.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity, subject to the same privacy protections described in this Policy.
  • With Your Consent: We may share your information for any other purpose with your explicit prior consent.

Artificial Intelligence & Automated Processing: Rock'n Rideshare uses limited AI-assisted tools solely for internal administrative purposes, such as parsing text-based ride requests entered by our staff. Your personal data — including your name, phone number, email address, pickup and dropoff locations, payment information, and ride history — is never transmitted to, processed by, or used to train any external artificial intelligence system, including but not limited to OpenAI, Anthropic, Google, or any other AI provider. We do not use your data for machine learning model training, profiling for advertising purposes, or any automated decision-making that produces legal or similarly significant effects on you. Any AI-assisted features operate exclusively on data you voluntarily provide in the moment and do not retain or share that data beyond the immediate transaction. If our data practices change in a material way, we will update this Policy and notify you in advance.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with our services. Ride records and transaction data are retained for a minimum of seven (7) years to comply with applicable tax, insurance, and regulatory requirements. Driver documents, including background check results and insurance records, are retained for the duration of the driver's engagement with the Platform plus three (3) years. Dashcam recordings are retained for thirty (30) days unless they are associated with an active safety investigation, insurance claim, or legal proceeding, in which case they are retained until the matter is fully resolved.

Upon account deletion, we will delete or anonymize your personal information within thirty (30) days, except where retention is required by law or for legitimate business purposes such as fraud prevention or legal compliance.

6. Your Privacy Rights

Depending on your state of residence, you may have the following rights regarding your personal information:

  • Right to Know: You may request a copy of the personal information we hold about you.
  • Right to Correct: You may request that we correct inaccurate personal information.
  • Right to Delete: You may request deletion of your personal information, subject to legal retention requirements.
  • Right to Data Portability: You may request your data in a portable, machine-readable format.
  • Right to Opt Out of Sale: We do not sell personal information. If this practice changes, we will provide a clear opt-out mechanism.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.

To exercise any of these rights, please submit a request through our page, or contact us at the address provided in Section 11 below. We will respond to verified requests within forty-five (45) days as required by the Florida Digital Bill of Rights.

7. Children's Privacy (COPPA)

Rock'n Rideshare is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. Our Platform requires age verification at registration, and any user determined to be under 13 is blocked from creating an account. If we discover that we have inadvertently collected personal information from a child under 13, we will delete that information immediately. If you believe we have collected information from a child under 13, please contact us immediately at the address in Section 11.

Riders between the ages of 13 and 17 may use the Platform only with documented parental or guardian consent, and only when accompanied by an adult. Unaccompanied minors under 18 are not permitted to use Rock'n Rideshare without prior written parental consent and enhanced monitoring arrangements as described in our Terms of Service.

8. Data Security

We implement industry-standard technical and organizational security measures to protect your personal information against unauthorized access, disclosure, alteration, or destruction. These measures include encryption of data in transit using TLS/SSL, encryption of sensitive data at rest, access controls limiting data access to authorized personnel, regular security assessments, and secure cloud storage infrastructure. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

In the event of a data breach that affects your personal information, we will notify you and applicable regulatory authorities as required by Florida law and other applicable regulations.

9. Third-Party Links and Services

Our Platform may contain links to third-party websites or services, including our merchandise store. We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party services you access through our Platform. Our use of Google Maps services is subject to Google's Privacy Policy available at https://policies.google.com/privacy.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by posting the updated Policy on our Platform with a new "Last Updated" date and, where required by law, by sending you a direct notification. Your continued use of the Platform after any changes constitutes your acceptance of the updated Policy. We encourage you to review this Policy periodically.
