1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Rock'n Rideshare ("Company," "we," "us," or "our"), a Transportation Network Company (TNC) operating in the State of Florida pursuant to Florida Statute § 627.748. These Terms govern your access to and use of the Rock'n Rideshare mobile application, website, and all related services (collectively, the "Platform").

By creating an account, accessing, or using the Platform in any way, you represent that you are at least 18 years of age (or at least 13 years of age with documented parental consent), that you have the legal authority to enter into these Terms, and that you agree to comply with all applicable laws and regulations.

2. Description of Service

Rock'n Rideshare is a technology platform that connects riders seeking prearranged transportation with independent contractor drivers. Rock'n Rideshare is not a transportation company and does not provide transportation services directly. All transportation services are provided by independent contractor drivers who are not employees, agents, or representatives of Rock'n Rideshare. Rock'n Rideshare's role is limited to operating the digital network that facilitates connections between riders and drivers, consistent with the definition of a Transportation Network Company under Florida Statute § 627.748(1)(e).

Rock'n Rideshare currently operates in the Lady Lake and The Villages area of Florida. Service availability is subject to driver availability and geographic limitations. We are actively expanding our service area and driver network.

3. Assumption of Risk and Liability Disclaimer

To the maximum extent permitted by applicable law, Rock'n Rideshare, its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform or transportation services, including but not limited to personal injury, property damage, loss of data, or economic losses, even if Rock'n Rideshare has been advised of the possibility of such damages.

Rock'n Rideshare's total liability to you for any claim arising from or related to these Terms or your use of the Platform shall not exceed the total amount of fees paid by you to Rock'n Rideshare in the twelve (12) months preceding the claim. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Rock'n Rideshare makes no warranty that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

4. Rider Terms and Conditions

4.1 Eligibility and Age Requirements

Riders must be at least 13 years of age to create an account. Riders under the age of 18 are considered minors and may only use the Platform with documented parental or guardian consent. Unaccompanied minors under the age of 18 are not permitted to ride without prior written parental consent on file with Rock'n Rideshare. Drivers reserve the right to decline service to unaccompanied minors. Rock'n Rideshare does not permit children under the age of 13 to use the Platform under any circumstances.

4.2 Payment and Fees

All riders must maintain a valid payment method on file. Fares are calculated based on distance at a rate of $1.75 per mile plus applicable base fees. Airport rides to Tampa International Airport (TPA), Orlando International Airport (MCO), and Orlando Sanford International Airport (SFB) are charged at a flat rate of $90.00 due to distance and fuel costs. Fares are subject to change with notice.

Riders agree to pay all applicable fees, including cancellation fees for rides cancelled after a driver has been dispatched, and vehicle cleanup fees in the event that a rider causes damage to or soils the interior of a driver's vehicle. Cleanup fees range from $25 to $150 depending on the severity of the incident, consistent with industry standards.

4.3 Passenger Declarations

Riders must accurately declare the number of passengers, the presence of pets, and the presence of children before booking a ride. Failure to accurately declare passengers or pets may result in driver cancellation without refund. Service animals are always permitted pursuant to applicable law.

4.4 Rider Conduct

Riders are expected to treat drivers with respect and courtesy at all times. Conduct that is abusive, threatening, discriminatory, or otherwise inappropriate is strictly prohibited and may result in immediate suspension or permanent removal from the Platform. Rock'n Rideshare reserves the right to remove any rider who accumulates a pattern of complaints or whose average rating falls below an acceptable threshold. Removed riders will be flagged and will not be permitted to create new accounts.

5. Driver Terms and Conditions

5.1 Independent Contractor Status

All drivers on the Rock'n Rideshare Platform are independent contractors, not employees, agents, or partners of Rock'n Rideshare. As an independent contractor, you are responsible for your own taxes, insurance, vehicle maintenance, and compliance with all applicable laws. Nothing in these Terms creates an employment relationship, partnership, joint venture, or agency relationship between you and Rock'n Rideshare. You retain the right to work for other companies, including other rideshare platforms, and to set your own hours.

5.2 Insurance Requirements

Pursuant to Florida Statute § 627.748(7), all drivers must maintain automobile insurance that provides at minimum: (a) while logged on but not on an active ride — $50,000 per person / $100,000 per incident for death and bodily injury, and $25,000 for property damage; and (b) while on an active prearranged ride — $1,000,000 primary liability coverage for death, bodily injury, and property damage. Drivers must upload proof of qualifying insurance to the Platform and keep it current at all times. Failure to maintain required insurance will result in immediate suspension from the Platform.

5.3 Dashcam Requirement

All drivers are required to operate a dual-facing dashcam system that records both the front exterior of the vehicle and the interior passenger cabin during all active rides. This requirement exists for the safety of both drivers and riders, for insurance claim documentation, and for compliance with Rock'n Rideshare's safety standards. Drivers must disclose the presence of recording equipment to riders before each ride, and riders must provide explicit consent before the ride begins. Failure to operate required dashcam equipment may result in suspension.

5.4 Driver Identification Sticker

All approved drivers are required to display the official Rock'n Rideshare identification sticker in their vehicle's rear window before accepting rides. This requirement helps riders identify official Rock'n Rideshare vehicles for their safety. Stickers are provided by Rock'n Rideshare upon driver approval.

5.5 Background Check

All drivers must consent to and pass a comprehensive background check, including criminal history and motor vehicle record review, before being approved to drive on the Platform. Drivers with recent accidents, DUI convictions, or serious criminal history will not be approved. Rock'n Rideshare reserves the right to conduct periodic re-screening.

6. Recording Consent — Florida Law Notice

Florida is an all-party consent state under Florida Statute § 934.03. This means that all parties to a conversation must consent before it may be recorded. By using the Rock'n Rideshare Platform, both riders and drivers acknowledge and consent to audio and video recording during all rides. This consent is a condition of using the Platform. If you do not consent to being recorded, you may not use the Rock'n Rideshare service.

7. Rating System and Community Standards

Rock'n Rideshare operates a mutual rating system in which riders rate drivers and drivers rate riders after each completed ride. Ratings are used to maintain service quality and community safety. Rock'n Rideshare reserves the right to suspend or permanently remove drivers or riders whose ratings fall below acceptable thresholds or who accumulate a pattern of conduct complaints. Removal decisions are made at Rock'n Rideshare's sole discretion and are final.

Rock'n Rideshare does not discriminate on the basis of race, color, national origin, religion, sex, disability, or any other protected characteristic. Any driver or rider found to have engaged in discriminatory conduct will be immediately removed from the Platform.

8. Prohibited Uses

You agree not to use the Platform to:

• Violate any applicable law or regulation
• Harass, threaten, or harm any other user
• Provide false or misleading information
• Circumvent any safety or security feature of the Platform
• Engage in fraudulent activity, including fare manipulation or false complaints
• Transport illegal substances or contraband
• Operate a vehicle while impaired by alcohol or drugs
• Use the Platform for any commercial purpose other than providing or receiving rides

9. Dispute Resolution

Any dispute arising out of or related to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Florida. You waive any right to participate in a class action lawsuit or class-wide arbitration. These Terms shall be governed by the laws of the State of Florida without regard to its conflict of law provisions.

10. Modifications to Terms

Rock'n Rideshare reserves the right to modify these Terms at any time. When we make material changes, we will notify you by posting the updated Terms on the Platform with a new "Last Updated" date and, where required, by sending a direct notification. Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms.
